Some West Africans who had been deported from the U.S. to Ghana had been held in “straitjackets” for 16 hours on a flight throughout which all passengers had been shackled and given solely bread and water, in line with a lawsuit filed Friday.

The lawsuit, filed in federal courtroom in Washington on behalf of 5 migrants, says passengers had been awoken in the midst of the night time on Sept. 5 and never informed the place they had been going till hours into the flight on a U.S. navy cargo aircraft.

The migrants have been detained for 5 days in Ghana in “squalid circumstances and surrounded by armed navy guards in an open-air detention facility,” referred to as Dema Camp, the criticism says. Situations are “abysmal and deplorable,” with tents for shelter and little working water.

The migrants will not be from Ghana and have been informed they are going to be despatched to different nations which have been decided to be too harmful by U.S. immigration judges — making it the most recent authorized problem to the Trump administration’s follow of sending folks to nations aside from their very own, together with El Salvador, Panama, Costa Rica and several other African nations.

The criticism, filed by legal professionals for Asian People Advancing Justice, asks a decide to instantly halt deportations to their nations of origin.

“Defendants have enlisted the federal government of Ghana to do their soiled work,” it says. “Regardless of the minimal, pass-through involvement of the Ghanaian authorities, Defendants’ goal is obvious: deport people who’ve been granted fear-based aid from being despatched to their nations of origin to these nations anyway, in contravention to the rulings of U.S. immigration judges and U.S. immigration legislation.”

The Homeland Safety Division and U.S. Immigration and Customs Enforcement didn’t instantly reply to a request for remark.

The lawsuit was filed a day after Ghana’s president confirmed the arrival of the 14 deportees. Ghana joined Eswatini, Rwanda and South Sudan as African nations which have acquired migrants from third nations who had been deported from the U.S., an method whose legality has been questioned by legal professionals and human rights organizations.

President Donald Trump has been aggressively cracking down on immigrants he describes as criminals and “aliens” from nations whose nationals have overstayed their visas within the U.S.

Attorneys and activists have stated the Trump administration seems to be making such requests to the nations most affected by his insurance policies on commerce, migration and help.

Not one of the 14 deportees had been initially from Ghana and the 5 West-Africans who filed the lawsuit didn’t have ties with the nation or designate it as a possible nation of removing, in line with the criticism.

Plaintiffs are recognized solely by initials within the criticism. 4 are “in quick hazard of being despatched on, inside hours, to their nations.” One has already been eliminated to The Gambia and is in hiding, regardless of having “repeatedly acknowledged his worry” of returning to his nation.

Three plaintiffs are from Nigeria and two from The Gambia. The lawsuit says 14 West Africans had been taken from their cells at an ICE detention heart in Alexandria, Louisiana.
