Washington — A federal choose in New York on Wednesday declined the Justice Division’s request to unseal grand jury materials within the case of late intercourse offender Jeffrey Epstein, saying prosecutors had didn’t display that “particular circumstances” warranted the disclosure.

Choose Richard Berman of the U.S. District Courtroom for the Southern District of New York issued his ruling in a 14-page resolution denying the federal government’s movement to unseal the paperwork.

Berman wrote that the grand jury materials in query contains the testimony of only a single witness, an FBI agent “who had no direct information of the information of the case and whose testimony was principally rumour.” The paperwork the federal government was searching for to unseal included roughly 70 pages of transcripts of the agent’s two displays to the grand jury, a PowerPoint exhibit and a name log.

Berman famous that the Justice Division’s information on Epstein dwarf these stemming from the grand jury. Proceedings earlier than grand juries are sometimes saved secret.

“A major and compelling purpose to reject the Authorities’s place on this litigation is that the Authorities has already undertaken a complete investigation into the Epstein case and, not surprisingly, has assembled a ‘trove’ of Epstein paperwork, interviews, and displays. And, the Authorities dedicated that it will share its Epstein investigation supplies with the general public,” Berman wrote.

“The Authorities is the logical get together to make complete disclosure to the general public of the Epstein Information. By comparability, the moment grand jury movement seems to be a ‘diversion’ from the breadth and scope of the Epstein information within the Authorities’s possession,” Berman wrote, quoting a call by one other choose in New York who denied the federal government’s transfer to unseal materials within the case of Ghislaine Maxwell, Epstein’s co-conspirator who’s serving a 20-year sentence on sex-trafficking expenses.

“The knowledge contained within the Epstein grand jury transcripts pales compared to the Epstein investigation info and supplies within the arms of the Division of Justice,” he concluded.

Berman wrote that the grand jury materials is “merely a rumour snippet of Jeffrey Epstein’s alleged conduct.” He cited “potential threats to victims’ security and privateness” as one of many elements that weighed in favor of not releasing the paperwork.

The Justice Division declined to touch upon Berman’s ruling.

The household of Virginia Giuffre, one in all Epstein’s most well-known accusers, who died by suicide earlier this 12 months, stated in an announcement, “We applaud Choose Richard Berman’s resolution to not launch the grand jury testimony within the Ghislaine Maxwell case. We wholeheartedly agree along with his evaluation that the Division of Justice (DOJ) is making a diversion with its actions relating to the grand jury movement, which distracts from the huge scope of the Epstein information within the authorities’s possession.”

“We acknowledge the vital significance of defending survivors; it’s important that we redact any info that would jeopardize their security or privateness. Their well-being should all the time be our precedence,” the household stated. “On the similar time, we demand accountability for all people implicated in these heinous acts. These accountable should be held to the fullest extent of the legislation. We won’t settle for something lower than justice for Virginia and all survivors.”

In July, the Justice Division requested the judges overseeing the Maxwell and Epstein circumstances to launch the grand jury materials that fashioned the premise for the federal expenses in opposition to them, a transfer that got here amid uproar over the division’s overview of the so-called “Epstein information” and resolution to not launch further paperwork within the authorities’s possession.

Epstein was investigated by federal authorities in Florida within the 2000s, a probe that resulted in a non-prosecution settlement and a responsible plea on state prostitution expenses. He was arrested once more on federal intercourse trafficking expenses in 2019 and died in a Manhattan jail weeks later. A number of investigations decided he died by suicide.

There was growing strain on the Trump administration from Democrats and lots of Republicans to reveal extra details about the Epstein case. The Justice Division issued findings of a overview of the Epstein investigation in July, saying it had discovered no proof of a “consumer checklist” or indication that Epstein blackmailed outstanding figures, an announcement that spurred extra questions from skeptics.

Republicans in Congress have pushed for extra transparency for the reason that Justice Division’s overview. The Home Oversight Committee issued a subpoena to the division for paperwork associated to Epstein earlier this month. The committee stated Tuesday that it expects to obtain paperwork later this week, and intends to start releasing them pending a overview to redact victims’ info.
