In a written declaration submitted to the court docket Friday, Noem stated she made the choice to not return the planes to the U.S. after receiving “privileged authorized recommendation” from the Homeland Safety Division’s performing basic counsel and “by means of him from the senior management of the Division of Justice.”

Boasberg, who was nominated to the federal bench by President Barack Obama, a Democrat, referred to as Noem’s declaration “cursory.”

“As this declaration doesn’t present sufficient data for the Court docket to find out whether or not her resolution was a willful violation of the Court docket’s Order, the Court docket can’t at this juncture discover possible trigger that her actions constituted felony contempt,” the decide wrote in Monday’s order.

The administration has stated it didn’t violate Boasberg’s order. The decide’s directive to return the planes was made verbally in court docket however not included in his written order, authorities attorneys stated in a court docket submitting in November.

That order blocked the administration from eradicating “any of the person Plaintiffs from the USA for 14 days,” however stated nothing in regards to the flights already airborne, they stated.

The 2 planes had already departed U.S. territory and airspace, so the migrants aboard them had already been “eliminated” and subsequently fell exterior of the court docket’s order, Justice Division legal professionals stated within the court docket submitting.
