A controversial proposal by a Sydney developer to construct a six-storey beachfront tower in Bondi has been unanimously rejected by the local planning panel, following strong opposition from residents of a neighbouring seniors’ housing complex. The development, which aimed to leverage an affordable housing incentive scheme, was criticized by residents as a form of “elder abuse” that would have significantly diminished their natural light and ocean views.

Developer’s Plan and Resident Objections

The proposal, put forward by STM123 No. 32 Pty Ltd, sought to redevelop a narrow 7-metre-wide site at 34 Campbell Parade. The plan included a ground-floor shop, two high-end dual-level apartments, and a single affordable housing unit. However, the project faced a significant backlash, with over 770 objections lodged against it. Residents argued that the development would obstruct windows and block prized ocean vistas from adjacent properties, contributing to overdevelopment along the popular beachfront. Crucially, they contended that it represented a misuse of planning incentives designed to address the housing crisis.

The campaign against the development was spearheaded by residents of the Astra building, a heritage-listed former hotel that now serves as independent accommodation for seniors. Situated directly north of the proposed site, the Astra building overlooks the Bondi Trattoria restaurant. Planning documents revealed that the proposed six-storey structure would have extended along the Astra’s southern boundary, casting a shadow over dozens of studio apartments occupied by elderly residents and severely limiting their access to natural light and sea breezes.

Impact on Vulnerable Residents

For many long-term residents of the Astra, the prospect of losing their connection to the outside world was a source of deep anxiety. Frances Stumbles, 88, who has limited mobility, expressed her distress. “I moved into the Astra 13 years ago and through my windows, my only windows, I look out onto the world,” she stated. “I enjoy the natural light and the sea breeze. With this proposal I was terrified at the prospect of looking onto a blank six-storey wall. Quite simply, I would have been walled in.”

Another resident, Cleo Lynch, 87, went further, labelling the proposal “blatant elder abuse with a gender bias.” She highlighted that many of the affected residents were older women who relied on the Astra for continued independent living. “Some residents rarely leave their units because of mobility or health issues, and this development would have condemned them to spend their last years in a bricked-up prison,” Lynch asserted. “Elderly we might be but stupid we’re not. The justification for the proposal – affordable housing opposite Bondi Beach – is an oxymoron.”

Debate Over Affordable Housing Incentives

The dispute brought into sharp focus the NSW government’s Housing State Environmental Planning Policy. This policy allows developers to gain significant bonuses in building height and floor space – typically 30% – in exchange for dedicating a portion of new developments to affordable housing for a set period, usually 15 years. In this instance, the policy allowed the developer to increase the height limit from the local control of 15 metres to 19.5 metres. The proposed building measured 19.3 metres, falling just short of the maximum allowed under the incentive but still significantly exceeding the standard limit.

Waverley councillor Margaret Merton questioned the efficacy of such schemes when luxury apartments dominated new builds. “None of the residents are opposed to more housing but building one affordable unit and two luxury apartments does nothing to address the housing shortage we’re in,” she commented. This sentiment echoed concerns that the affordable housing component was merely tokenistic, designed to unlock greater development potential for luxury units.

Developer’s Defence and Planning Panel’s Decision

Lee Kosnetter, the developer’s planning consultant, defended the proposal. He argued that the affordable housing component was substantial, representing approximately 20% of the residential floor space. He noted that these units would be rented to essential workers, such as nurses, police officers, and teachers, at rates between $700 and $750 per week, a stark contrast to the over $2000 per week charged for comparable market rentals in Bondi. Kosnetter stated that a comprehensive list of local key workers eager for accommodation was available.

The planning documents submitted by the developer asserted that the building’s design minimized impacts on neighbours, adhered to view-sharing principles, and would revitalize a site that had been underutilized for decades. Initially, Waverley Council’s planning staff had recommended approval, acknowledging the significant loss of views for Astra residents but concluding that such views could not be guaranteed upon redevelopment of surrounding sites.

However, the four-member Waverley Council Local Planning Panel ultimately sided with the residents. The panel unanimously refused the application, citing “the substantial amenity and view impacts” on the Astra building. They determined that these negative impacts outweighed the public benefit offered by a single affordable housing apartment.

Community Relief and Future Implications

The decision was met with relief by Astra residents. Len Horne, a resident, expressed his gratitude, emphasizing the Astra’s role as a vital affordable housing option in Bondi. “The Astra is one of the few affordable housing options in Bondi, and the proposal has caused enormous anxiety, residents asking: ‘If this is built next door to us, what will we do? Where will we go?’” he said. “We understand Sydney needs more housing but this proposal pushed the boundaries of every planning control. It was simply the wrong development for this site.”

The rejection of the Campbell Parade development underscores the ongoing tension between the need for increased housing supply in Sydney and the protection of existing residents’ amenity, particularly vulnerable populations. It highlights the critical scrutiny that planning incentive schemes face when their application appears to prioritize luxury development over genuine community needs and the well-being of established residents.
