A prolific offender has been sentenced to eight weeks in custody after assaulting a supermarket manager with a wine bottle during a shoplifting incident. Zoe Bending, 50, attacked the manager at Heron Foods in High Street, Rowley Regis, on June 19, as she attempted to flee with stolen wine and steak. The assault left the manager feeling disoriented and unwell.

The incident occurred when the supermarket manager attempted to intercept Bending, who was observed stealing wine and steak from the premises. According to prosecution details presented in court, the manager managed to recover some of the stolen items, which fell to the floor amidst customer attempts to assist. Bending, holding a bottle of wine in her right hand, struck the manager on the side of the head with the bottle as the manager tried to retrieve it.

In a statement read to Birmingham Magistrates’ Court, the victim described the surprise and shock of the attack, noting that the blow left her feeling “sick” and “hazy.” She expressed that the unprovoked assault left her “shook up.”

Broader Pattern of Theft

The assault was part of a larger pattern of criminal activity. Bending pleaded guilty not only to the assault but also to a series of theft offenses. Between June and September of the same year, she stole items valued at hundreds of pounds from various retail outlets, including Tesco and One Stop branches. The stolen goods included a range of products such as alcohol, cheese, and laundry supplies.

During the court proceedings on Wednesday, September 16, the prosecution indicated that while details of all 12 theft offenses would not be elaborated upon individually, the Heron Foods incident served as a significant example of her conduct. The court heard that Bending had accumulated a substantial record of theft.

Mitigating Circumstances and Sentencing

Rumahn Hanna, representing Bending, presented mitigating circumstances to the court. He explained that Bending had been experiencing a “chaotic period in her life,” particularly following the death of her brother. Financial difficulties were also cited as a contributing factor, with Bending reportedly struggling due to capped housing benefits.

Despite these circumstances, the court determined that an immediate custodial sentence was necessary. Mrs. Goodwin-Coles JP, delivering the sentence, emphasized the role of the victim as a member of the public providing a service. Bending, who was already in custody, received an eight-week sentence for the assault by beating and the 12 theft offenses. The sentences were ordered to run concurrently.

In addition to the custodial sentence, Bending was ordered to pay £100 in compensation to the victim. The court’s decision reflected the seriousness of the assault on a retail worker and the repeated nature of the theft offenses.
