The Coalition, the Greens, and other crossbench senators have indicated that the current proposals do not go far enough to mitigate the harms associated with gambling. Their collective stance suggests that the bill may struggle to gain sufficient support in the Senate without substantial revisions.

Government’s Position: Striking a Delicate Balance

Deputy Prime Minister Richard Marles has defended the government’s approach, emphasizing the complexity of the issue and the need to find a middle ground. Speaking on ABC Radio, Marles stated that the government believes it has achieved the appropriate balance with the proposed reforms. “It’s also an area where you need to strike a balance, and we believe we’ve done that,” he remarked. “We’re not saying that people should not be able to engage in betting, but there needs to be a balance, and it’s important.”

Marles further elaborated that the government has been engaged in a lengthy process to address this issue, acknowledging the diverse views within the community. He highlighted that the proposed laws represent the strongest measures of their kind ever brought before the parliament. “This has been an issue that we’ve been working through over a long period of time. It is complex. There are differing views across the community. We we understand that,” he said. He pointed to specific advancements, such as increased efforts to “break the link between gambling advertising and sport” and enhanced protections for children from exposure to gambling advertisements on television and radio.

Internal Dissent: Labor Backbenchers Call for More Stringent Measures

Despite the Deputy Prime Minister’s assurances, a segment of the Labor party’s backbench has voiced concerns and advocated for more robust reforms. Canberra MP Alicia Payne, for instance, has called for an opt-in system for gambling advertisements, arguing that individuals should have the agency to choose whether or not they are exposed to such content. “I do hope we can strengthen it, particularly, when with regards to inducements,” Payne stated. She underscored the personal impact of gambling industry practices, noting, “For anyone who has had a loved one who is trying to help themselves escape from the predatory approaches of the gambling industry knows that this needs to be addressed.”

This internal push reflects a broader sentiment among some government members that the current proposals do not sufficiently address the predatory nature of some gambling industry tactics, particularly concerning inducements and offers designed to encourage continued betting.

Crossbenchers Unite in Criticism

The criticism is not confined to the government’s own ranks. Independent Senator David Pocock has confirmed that he is collaborating with other crossbench senators to introduce amendments to the bill. Pocock expressed a unified view among non-government senators, stating, “Every non-government senator thinks that this bill is not strong enough. It’s not going to protect young Australians. It’s not going to stop the normalisation of gambling.” His comments suggest a significant hurdle for the government in securing the necessary votes for the reforms to pass the Senate in their current form.

The core of the crossbenchers’ argument centers on the perceived inadequacy of the proposed measures in safeguarding young people and in preventing the widespread normalization of gambling within society. They are advocating for amendments that would introduce more substantial restrictions and protections.

The Path Forward: Navigating Legislative Challenges

The government faces a complex legislative challenge as it attempts to pass its gambling reforms. While ministers maintain that the current proposals represent a balanced approach, the unified opposition from the Coalition, Greens, and crossbenchers, coupled with internal pressure from Labor backbenchers, indicates a strong likelihood that the bill will require significant amendments. The debate highlights the ongoing tension between regulating an industry and allowing individuals the freedom to participate in it, with a particular focus on protecting vulnerable populations from potential harm.
