Grindr, the world’s largest dating application for LGBTQ+ individuals, has agreed to a substantial settlement of £26 million to resolve allegations that it shared sensitive user information, including HIV status, with third parties. The resolution addresses claims brought forth in a class-action lawsuit that accused the company of misusing personal data.

Class-Action Lawsuit Details

The legal action originated in the High Court in 2024, with a class-action suit subsequently filed in the United States. The law firm spearheading the case reported securing over 11,000 claimants. According to a regulatory filing submitted to the U.S. Securities and Exchange Commission, Grindr will fulfill the settlement through two payments of £13 million each. Importantly, the settlement explicitly states that it does not constitute an admission of liability by Grindr.

Grindr has emphasized that the claims pertain to data handling practices that occurred prior to 2020, during a period when the company was under different ownership by a Chinese firm, Kunlun. The company acknowledged in its filing that while it disputes the allegations, it understands and respects the concerns and loss of trust expressed by some of its United Kingdom users regarding this historical period.

The agreed-upon payment schedule involves £13 million being paid to the counterparties by December 31st of the current year, followed by a second payment of £13 million by March 31, 2027.

Allegations of Sensitive Data Sharing

The lawsuit, initiated more than two years prior to the settlement, was brought by the law firm Austen Hayes. The core allegations centered on Grindr’s purported sharing of highly sensitive personal data with third parties for commercial gain, in violation of UK privacy legislation. This information allegedly included users’ ethnicity and sexual orientation.

Grindr offers users the option to disclose their HIV status and the date of their last test. The company has stated that this feature is intended to help reduce stigma, encourage open conversations about sexual health, and empower users to make informed decisions.

Chaya Hanoomanjee, the lawyer leading the claim, stated in April 2024 that claimants had suffered considerable distress due to their private and sensitive information being shared without their explicit consent. She asserted that the company has a responsibility to compensate individuals whose data was compromised, particularly given the community it serves.

Third Parties Involved and Historical Context

The legal claim identified two specific third-party data analytics services, Apptimize and Localytics, as entities that had access to this sensitive user data. The lawsuit contended that an unspecified number of other third parties also utilized this data to tailor advertisements specifically for Grindr’s user base.

These revelations followed earlier reports from 2018, which indicated that Grindr had been sharing personal data, including users’ HIV status, with these two data analytics providers. At the time, Grindr defended its practices, citing them as consistent with industry norms. However, the company subsequently ceased sharing HIV data with these particular third parties.

This situation is not without precedent for regulatory scrutiny. Grindr previously faced a £5.5 million fine from Norway’s data protection authority and received a reprimand from the UK’s Information Commissioner’s Office in 2022 concerning its data handling practices.

Grindr’s Response and Future Commitments

In its recent filing, Grindr stated that it has undertaken a comprehensive overhaul of its privacy protocols since 2020. These changes are designed to better address the specific needs and privacy expectations of its user community. The company reiterated its commitment to maintaining Grindr as a secure environment, emphasizing its dedication to transparency, user control over data, and responsible data management practices.

The settlement represents a significant financial resolution for the company, addressing long-standing concerns about data privacy and user trust within the LGBTQ+ community.
