Tenisha Warner, the widow of late actor Malcolm-Jamal Warner, has initiated legal proceedings seeking approximately $1.27 million from a family trust managed by his mother, Pamela Warner. The lawsuit, filed in Georgia’s DeKalb County Superior Court, comes exactly one year after the 54-year-old actor tragically drowned while on vacation in Costa Rica.

Legal Action Over Estate and Last Wishes

Tenisha Warner stated that she has been attempting to resolve her late husband’s complex estate privately and fulfill his final wishes. She emphasized that Malcolm-Jamal Warner intended to provide for their nine-year-old daughter, MacKenzie, and herself. According to Tenisha, the actor was close to finalizing an updated estate plan, intending to replace a plan established in 1996 when he was 26, long before they met and had their daughter.

The actor, widely recognized for his role as Theo Huxtable on “The Cosby Show,” passed away before he could implement these changes. Tenisha explained that she has been managing their daughter’s care as a single mother and sole provider. She felt compelled to take legal action to safeguard their rights before any potential statute of limitations expired.

Prenuptial Agreement and Unmet Financial Obligations

The lawsuit details a prenuptial agreement made on May 15, 2022, between Tenisha and the late actor. In this agreement, Malcolm-Jamal Warner reportedly consented to naming her the sole beneficiary of a $1 million life insurance policy. However, Tenisha claims he did not take the necessary steps to finalize this or other financial arrangements before his death.

Specific financial obligations cited in the suit include:

  • Failure to purchase or maintain the agreed-upon life insurance policy.
  • Unpaid expenses, such as yearly tax-free payments totaling over $50,000, stipulated to be paid on each anniversary of their marriage.
  • An agreement to place $30,500 into a Roth IRA in Tenisha’s name.
  • Monthly payments of $5,000 for her work as his chief of staff and assistant, amounting to approximately $195,000.

Tenisha asserts that the estate has not been adequately funded and seeks to access assets from a family trust established by the actor and controlled by his mother. She maintains that she fulfilled all her obligations under the prenuptial agreement, including remaining in the marriage until the decedent’s death. The filing states that the decedent died without satisfying his obligations, and the sums due to her have not been paid.

Trust Litigation and Asset Preservation

A separate filing in the Los Angeles Superior Court names “The Warner Family Trust, dated October 7, 1996,” as the basis for the requested sum of $1,276,042.46, plus associated costs. The legal actions include petitions for the conveyance of trust property, establishing the payee of the trust, preserving protective actions, determining the omitted spouse’s beneficial interest, instructing the trustee to preserve assets, and demanding an accounting from the trustee.

Tenisha has requested the court to place a hold on the estate’s assets to prevent their distribution while the legal case is resolved. In a July 17 petition, she stated she is owed at least the specified amount, in addition to prejudgment and postjudgment interest, attorneys’ fees, and costs.

Anniversary of Death and Mother’s Reflections

The legal actions coincide with the one-year anniversary of Malcolm-Jamal Warner’s passing. On this somber occasion, Pamela Warner shared a statement on a memorial page for her son. She reflected on the past year, describing it as a period of pain, loss, emotional destabilization, and significant personal growth. She noted the unimaginable challenges life can present.

Pamela Warner also spoke about the difficult life lessons she has encountered since her son’s tragic death. She expressed discovering both the cruelty and greed of some individuals, alongside the profound depth of love, care, and support that others are capable of. She concluded her message by urging everyone to cherish and express their love for their family members, resolve conflicts, and cleanse themselves of negativity, acknowledging that everyone has an “expiration date.”
