A man who committed a sex act while seated next to a mother and her infant on an Emirates flight from Dubai to Newcastle has received a community order instead of a prison sentence. Britto Lorence, 27, from India, exposed himself on the long-haul journey in June of the previous year.

Details of the Incident

Lorence, who holds a Master’s qualification in biotechnology engineering, was occupying one of three seats in a row, with the other two seats taken by the mother and her baby son. The court heard that as the woman stood up to attend to her child, she noticed Lorence had a blanket over his lap. Initially concerned he might be concealing a weapon, she soon realized he was performing a sex act.

The incident occurred on an Emirates flight traveling from Dubai to the UK. Following the discovery, Lorence was reported to the cabin crew and subsequently arrested upon the flight’s arrival at Newcastle International Airport.

Legal Proceedings and Plea Change

Lorence initially pleaded not guilty to one count of outraging public decency at an earlier court appearance, with the case being prepared for trial. However, on the scheduled day for the trial at Newcastle Magistrates’ Court in May, he altered his plea to guilty.

The case was adjourned for a pre-sentence report to be prepared. During this period, Lorence sought to withdraw his guilty plea, claiming he felt pressured into admitting the offense. However, District Judge Kate Meek refused this application during a hearing this week, stating that his guilty plea would stand. Consequently, Lorence was convicted based on his plea.

Sentencing and Judge’s Remarks

District Judge Kate Meek sentenced Lorence to an 18-month community order, which includes a requirement for 150 hours of unpaid work. He was also ordered to pay a total of £914, comprising costs and a victim surcharge.

The judge emphasized the seriousness of the offense, noting that it was exacerbated by the captive audience on an airplane, where victims cannot easily remove themselves from the situation. She specifically highlighted that the incident occurred next to a very young child.

“Your guilty plea stands. You’re convicted by your guilty plea and you fall to be sentenced. Your offence was a serious offence,” the judge stated. “It is also going to be treated more seriously because the people affected by it were passengers on a plane and they couldn’t absent themselves from the situation, and one of those people sat next to you was a very young child.”

Regarding the credit given for the guilty plea, the judge commented, “I acknowledge you pleaded guilty on the day of your trial but you have then done all you can to try and set aside that plea so you will receive a very small amount of credit.”

Victim’s Statement and Defendant’s Background

During a previous hearing, the prosecution outlined that the victim had described Lorence initially appearing to be asleep with a pillow on his lap. She raised the alarm by alerting cabin staff after noticing his indecent behavior.

In a statement read to the court, the victim expressed that she had been “deeply distressed” by the incident. She explained that she had attempted to remain calm during the flight to avoid alarming her son further. Upon learning that she would not need to testify in a trial, she described it as “a blessing” and expressed prayers for the individual involved.

The court was informed that Lorence held a visa to work in the UK and had been employed as a cafe manager. His educational background includes a Master’s degree in food science from Teesside University and a BTech in biotechnology from Abdul Kalam Technological University in India. Prior to his role in the UK, he worked as a development technologist with Zaara Biotech LLC.

Despite the conviction based on his guilty plea, Lorence has maintained his denial of committing the offense. The community order and unpaid work represent the court’s judgment in this case, balancing the seriousness of the public indecency offense against the circumstances and the defendant’s actions during the legal process.
